UP AGAIN BOXING TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Up Again Boxing mobile application and related services (collectively, the "App").

By creating an account, accessing, or using Up Again Boxing, you agree to these Terms. If you do not agree with these Terms, you should not use the App.

1. ABOUT UP AGAIN BOXING

Up Again Boxing is a boxing and fitness training application designed to provide training sessions, exercise guidance, training information, progress tracking, and related fitness features.

The App may include personalised training recommendations, AI-powered features, workout tracking, heart-rate information, and integrations with compatible health and fitness platforms.

2. ELIGIBILITY

You must be legally permitted to use the App in your jurisdiction.

If you are under the age of 18, you should only use the App with the involvement and permission of a parent or legal guardian where required by applicable law.

You are responsible for ensuring that your use of the App complies with the laws applicable to you.

3. YOUR ACCOUNT

Certain features require you to create an account.

You are responsible for:

  • Providing accurate information

  • Maintaining the security of your account

  • Keeping your login credentials confidential

  • All activity that occurs through your account

  • Not allowing unauthorised people to access your account

You must notify us if you believe your account has been compromised or accessed without permission.

We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner that may harm the App, its users, or our services.

4. TRAINING AND FITNESS DISCLAIMER

Up Again Boxing provides general fitness and boxing training information.

The App is not a medical service and does not provide medical advice, diagnosis, treatment, or medical supervision.

You are responsible for determining whether an exercise or training session is appropriate for you.

You should consult an appropriately qualified healthcare professional before beginning or changing an exercise program if you have any medical concerns, injuries, conditions, or other factors that may affect your ability to exercise safely.

You understand that boxing, strength training, running, conditioning, and other physical activities involve inherent risks, including but not limited to:

  • Muscle strains

  • Sprains

  • Falls

  • Joint injuries

  • Fractures

  • Head injuries

  • Concussion

  • Cardiovascular events

  • Other physical injury

You voluntarily assume the risks associated with participating in physical exercise and boxing training.

5. USE OF HEART-RATE AND HEALTH INFORMATION

Up Again Boxing may integrate with Apple Health/HealthKit and Android Health Connect.

Where you provide the necessary permissions, the App may read certain health and fitness information, such as resting heart rate, and may write workout or exercise information to these platforms.

Health and fitness information provided by wearable devices, smartwatches, Apple Health, HealthKit, or Health Connect may be inaccurate, delayed, incomplete, or unavailable.

You should not rely on information displayed by Up Again Boxing for medical diagnosis, emergency decisions, or other medical purposes.

If you experience concerning symptoms during exercise, stop exercising and seek appropriate medical attention.

6. PERSONALised TRAINING

Up Again Boxing may use information such as your training history, profile information, goals, preferences, performance information, and permitted health and fitness information to personalise your training experience.

Personalised training recommendations are generated for general fitness purposes.

Training recommendations are not guaranteed to be appropriate for every individual or circumstance.

You remain responsible for deciding whether to follow any training recommendation provided by the App.

7. ARTIFICIAL INTELLIGENCE FEATURES

Up Again Boxing may use artificial intelligence, including Google's Gemini technology, to provide features such as:

  • Training recommendations

  • Training plans

  • Exercise suggestions

  • Coaching information

  • Training analysis

  • Responses to user questions

  • Other AI-powered functionality

AI-generated information may contain errors, inaccuracies, omissions, or inappropriate recommendations.

AI-generated content should be treated as general fitness guidance rather than professional medical, coaching, or other specialised advice.

You are responsible for evaluating whether AI-generated recommendations are appropriate for you.

We do not guarantee that AI-generated information will always be accurate, complete, suitable, or error-free.

8. EXERCISE EQUIPMENT AND TRAINING ENVIRONMENT

You are responsible for ensuring that any equipment you use with the App is suitable, properly maintained, and used safely.

This includes boxing bags, gloves, wraps, weights, resistance equipment, gym equipment, and any other training equipment.

You are also responsible for ensuring that your training environment is appropriate and free from reasonably foreseeable hazards.

Up Again Boxing does not supervise your training environment or physical activity.

9. SUBSCRIPTIONS

Certain features of Up Again Boxing may require a paid subscription.

Subscription prices, billing periods, trial periods, and available plans will be displayed before purchase.

Subscriptions may be managed through Apple's App Store or Google Play and subscription management services such as RevenueCat.

Free Trials

If a free trial is offered, the duration and applicable conditions will be displayed at the time of signup.

Unless otherwise stated, a free trial may automatically convert into a paid subscription at the end of the trial period unless you cancel before the trial ends.

Automatic Renewal

Subscriptions may automatically renew unless cancelled in accordance with the applicable App Store or Google Play subscription settings.

You are responsible for managing your subscription and cancelling it before the renewal date if you do not wish to continue.

Refunds

Payments made through Apple or Google may be subject to their respective refund and purchase policies.

Where applicable, refund requests must be made through the platform through which the purchase was made.

We do not guarantee refunds except where required by applicable law.

10. CHANGES TO SUBSCRIPTION PRICING

We may change subscription prices from time to time.

Where required, you will receive appropriate notice of price changes before they take effect.

Your continued use of the applicable subscription after a price change takes effect constitutes acceptance of the new price, subject to applicable law and platform requirements.

11. USER CONTENT

You may be able to submit information or content to the App, including training information, feedback, text, images, videos, or other material ("User Content").

You retain ownership of your User Content.

By submitting User Content, you grant Up Again Boxing a limited licence to process, store, display, and use that content as reasonably necessary to provide the features of the App.

This may include processing content to provide AI-powered features, training analysis, progress tracking, or other functionality requested by you.

You are responsible for ensuring that you have the necessary rights and permissions to submit User Content.

12. PROHIBITED USE

You agree not to:

  • Use the App for unlawful purposes

  • Attempt to gain unauthorised access to the App or its systems

  • Interfere with the operation or security of the App

  • Reverse engineer or attempt to extract source code except where permitted by law

  • Copy, reproduce, distribute, or commercially exploit the App without permission

  • Circumvent subscription or payment systems

  • Use automated systems to abuse or overload the App

  • Upload malicious software or harmful content

  • Impersonate another person

  • Use the App to infringe the rights of another person

  • Attempt to manipulate, falsify, or abuse training or subscription data

13. INTELLECTUAL PROPERTY

The App and its contents, including its software, branding, logos, graphics, training content, text, designs, interfaces, and other materials, are owned by or licensed to Up Again Boxing and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, license, reproduce, or create derivative works from the App or its content.

Your use of the App does not give you ownership of the App or its intellectual property.

14. THIRD-PARTY SERVICES

The App may rely on third-party services and platforms, including:

  • Firebase

  • Google Gemini

  • RevenueCat

  • Apple Health/HealthKit

  • Android Health Connect

  • Apple App Store

  • Google Play

These services may have their own terms, policies, limitations, and requirements.

Up Again Boxing is not responsible for the availability, functionality, security, or policies of third-party services that are outside our control.

15. APP AVAILABILITY

We aim to keep Up Again Boxing available and functioning reliably, but we do not guarantee that:

  • The App will always be available

  • The App will be uninterrupted

  • The App will be free from errors

  • All features will always be available

  • Data will never be lost

  • Third-party integrations will always function

  • The App will be compatible with every device

We may modify, suspend, restrict, or discontinue features of the App from time to time.

16. DATA AND DEVICE COMPATIBILITY

Certain features depend on compatible devices, operating systems, wearable devices, internet connections, and third-party health platforms.

We are not responsible for failures caused by:

  • Unsupported devices

  • Operating system changes

  • Wearable device failures

  • Health platform changes

  • Internet connectivity

  • Third-party service outages

  • Incorrect permissions

  • Device settings

  • Hardware limitations

17. ACCOUNT SUSPENSION OR TERMINATION

You may stop using the App at any time.

We may suspend or terminate your access to the App if:

  • You materially breach these Terms

  • You engage in fraudulent or abusive activity

  • You attempt to compromise the security of the App

  • Your use creates a risk to other users or our services

  • We are required to do so by law

  • We discontinue the App or relevant services

Termination does not affect rights or obligations that arose before termination.

18. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, Up Again Boxing is provided on an "as is" and "as available" basis.

We make no guarantee that the App will meet your specific fitness goals or expectations.

We do not guarantee:

  • Specific fitness results

  • Weight loss

  • Muscle gain

  • Boxing performance improvements

  • Increased cardiovascular fitness

  • Injury prevention

  • Accuracy of wearable-device measurements

  • Accuracy of AI-generated recommendations

  • Continuous availability of the App

Your use of the App is at your own discretion and risk.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Up Again Boxing and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the App.

This includes, to the extent permitted by law, losses or damages arising from:

  • Physical injury

  • Loss of fitness or training progress

  • Reliance on training recommendations

  • Reliance on AI-generated information

  • Inaccurate health or fitness data

  • Wearable-device errors

  • Service interruptions

  • Loss of data

  • Third-party service failures

  • Unauthorised access or security incidents beyond our reasonable control

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot legally be excluded, restricted, or modified under applicable law.

20. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Up Again Boxing and its owners, operators, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Your misuse of the App

  • Your breach of these Terms

  • Your violation of applicable laws

  • Your violation of another person's rights

  • User Content you submit to the App

  • Your negligent or unlawful use of the App

21. PRIVACY

Your use of Up Again Boxing is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, and disclose personal information, including information associated with Apple Health/HealthKit and Android Health Connect.

22. CHANGES TO THESE TERMS

We may update these Terms from time to time.

When we make material changes, we may provide notice through the App or other appropriate means.

The updated Terms will become effective on the date specified at the beginning of the updated Terms.

Your continued use of the App after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

23. GOVERNING LAW

These Terms are governed by the laws applicable in the jurisdiction in which Up Again Boxing operates, without regard to conflict-of-law principles.

Any dispute will be handled in accordance with applicable law and the courts or dispute-resolution processes having appropriate jurisdiction.

Nothing in these Terms limits any mandatory consumer rights that apply to you under the laws of your country or region.
